The Ampast GSP governs all interactions with Ampast products, services, platforms, and intellectual property. By using any Ampast offering, you agree to all policies contained herein.
The Ampast Global Standard Policies consolidate the legal and operational framework governing all interactions with Ampast's products, services, and intellectual property into a single authoritative document. All Users, suppliers, clients, contributors, and third parties who engage with any Ampast offering are bound by the Ampast GSP.
The Ampast GSP is structured in five instruments: the Terms of Service, the Open Source Policy, the Standard Privacy Policy, the Modern Slavery Statement, and the Equal Treatment Statement. Each instrument governs a defined aspect of Ampast's operations and obligations.
Where a valid official written contract exists to which Ampast is a named party, that contract governs to the extent of any conflict with the Ampast GSP. In all other respects, the Ampast GSP applies universally and without exception. Ampast reserves the right to update the Ampast GSP at any time with or without notice.
These Terms of Service govern the use of all products, services, features, and offerings manufactured, programmed, sold, distributed, or sourced by Ampast. By accessing or using any Ampast product or service, you agree to be bound by these terms in their entirety.
"Ampast" refers to Ampast and its subsidiaries, affiliates, officers, employees, agents, partners, contractors, and licensors.
"Products" means any hardware, software, firmware, operating system, application, tool, device, component, or physical good manufactured, programmed, sold, given away, distributed, or sourced by Ampast, whether offered under the Ampast brand or through a third party.
"Services" means any online service, cloud service, application programming interface, platform, subscription, support offering, or digital service made available by Ampast, whether free of charge or subject to payment.
"User" means any individual, legal entity, government body, or organization that accesses, uses, purchases, subscribes to, receives, or interacts with any Ampast Product or Service.
"User Generated Content" or "UGC" means any content, data, text, files, code, feedback, communications, or materials submitted, uploaded, stored, or transmitted by a User through or in connection with any Ampast Product or Service, excluding content transmitted through or stored exclusively within Ampast email services designated as zero knowledge and software listed on Ampast online stores.
"Ampast GSP" or "Global Standard Policies" means the collection of Ampast policies, including the Terms of Service, the Open Source Policy, the Standard Privacy Policy, the Modern Slavery Statement, and the Equal Treatment Statement, as amended from time to time.
"Ampast Store" means any official Ampast digital storefront, marketplace, or distribution platform through which Ampast or third parties offer Products or Services.
By accessing, using, downloading, installing, purchasing, or otherwise interacting with any Ampast Product or Service, a User agrees to be bound by the Ampast GSP in its entirety.
If a User does not agree with any provision of the Ampast GSP, the User must immediately cease all use of Ampast Products and Services and must not access any Ampast platform, system, or offering.
The Ampast GSP applies in addition to any separate agreement, contract, end user license agreement, or subscription terms entered into between the User and Ampast. In the event of a conflict between the Ampast GSP and a valid official written contract to which Ampast is a named party, the terms of that official contract shall prevail to the extent of the conflict, and the Ampast GSP shall continue to govern all matters not addressed by such contract.
The Ampast GSP applies to all aspects of all Products and Services, including but not limited to any component, feature, function, API, patent, script, engine, design, chip, standard, or part thereof, whether manufactured, programmed, sold, given away, or sourced by Ampast or by any third party that incorporates any contribution from Ampast.
Except where a written warranty is expressly stated by Ampast in a separate product specific warranty document or agreement, all Ampast Products and Services are provided on an "as is" and "as available" basis without warranty of any kind.
To the maximum extent permitted by applicable law, Ampast expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including without limitation any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Ampast does not warrant or represent that any Product or Service will be uninterrupted, timely, secure, error free, or free of viruses or other harmful components.
Ampast does not warrant that any defects or errors in a Product or Service will be corrected, or that results obtained through use of any Product or Service will be accurate or reliable.
To the maximum extent permitted by applicable law, Ampast and its subsidiaries, affiliates, officers, directors, employees, agents, contractors, and licensors shall not be liable to any User or third party for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the use of, or inability to use, any Ampast Product or Service, regardless of the theory of liability.
In no event shall Ampast's total aggregate liability to any User for all claims arising from or related to any Ampast Product or Service exceed the greater of (a) the total amount paid by the User to Ampast in the twelve months preceding the claim, or (b) one United States Dollar (USD $1.00).
Each User agrees to defend, indemnify, and hold harmless Ampast and its subsidiaries, affiliates, officers, directors, employees, agents, contractors, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to: (a) the User's access to or use of any Ampast Product or Service; (b) any UGC submitted by the User; (c) the User's violation of the Ampast GSP; (d) the User's violation of any applicable law or regulation; or (e) any claim by a third party arising from the User's conduct.
All Users, suppliers, and clients must at all times take commercially reasonable steps to keep Ampast, its affiliates, officers, directors, employees, agents, and contractors free from any form of harm, legal exposure, financial liability, reputational damage, or regulatory sanction arising from their conduct or from their use of Ampast Products or Services.
Use of any Ampast Product or Service for commercial purposes, including resale, redistribution, sublicensing, incorporation into a commercial offering, or generating revenue, requires the prior exclusive written permission of Ampast.
Use of any Ampast Product or Service for research purposes, including academic research, market research, competitive analysis, security research, or any study intended for publication or external distribution, requires the prior exclusive written permission of Ampast.
Open source projects released by Ampast under the Ampast Open Source Policy are governed by the terms of that policy, and such terms constitute the exclusive written permission contemplated under Clauses 5.1 and 5.2 for purposes consistent with the scope of the applicable open source license.
Subject to Clause 6.2, all UGC submitted, uploaded, stored, or transmitted through any Ampast Product or Service is and shall become the exclusive property of Ampast upon submission or upload.
The provisions of Clause 6.1 do not apply to: (a) content transmitted through or stored exclusively within Ampast email services that are expressly designated as zero knowledge; or (b) software submitted by third party developers and listed on Ampast online stores, which shall be governed by the separate store agreement applicable to such developers.
With respect to any UGC not subject to Clause 6.2, each User irrevocably grants Ampast a worldwide, perpetual, royalty free, sublicensable, and transferable right and license to host, access, store, reproduce, modify, adapt, translate, distribute, publish, publicly display, publicly perform, and create derivative works of such UGC for any purpose, including commercial purposes, without compensation to the User.
The User represents and warrants that the User has all necessary rights, licenses, consents, and permissions to submit UGC and to grant the rights set forth in this Section 6, and that such UGC does not infringe any third party intellectual property rights, privacy rights, or any applicable law or regulation.
Notwithstanding Ampast's ownership of UGC under Clause 6.1, any and all legal claims, liabilities, or regulatory obligations arising from or related to any UGC shall be the sole and exclusive responsibility of the User who submitted such UGC. Ampast bears no liability for any UGC.
All UGC may be processed by Ampast for purposes of service improvement, system security, abuse detection, and product feature development, to the extent technically accessible to Ampast. UGC that is not technically accessible to Ampast due to zero knowledge encryption shall not be processed under this Clause.
Certain Products, Services, features, components of Products, and components of Services require payment prior to access or use. Ampast reserves the right to designate any Product, Service, feature, or component as a paid offering at any time.
All payments are subject to the pricing, billing, and refund terms applicable to the specific Product or Service purchased or subscribed to.
Purchase or subscription agreements for specific Products or Services, including but not limited to rental agreements for movies, software, or physical products, may contain terms that modify, supplement, or override the provisions of the Ampast GSP with respect to that specific Product or Service. In such cases, the specific purchase or subscription agreement shall govern to the extent of any conflict.
Ampast sells, distributes, or makes available Products and Services that include or incorporate products, services, software, or components sourced from third parties. The availability of such third party products or services through Ampast channels does not constitute endorsement by Ampast.
Ampast shall not be liable for any claims, damages, losses, or liabilities arising from or related to any third party product or service, whether offered independently or bundled with an Ampast Product or Service. All such claims must be directed to the applicable third party.
Third party products and services may be subject to their own separate terms and conditions, which the User is solely responsible for reviewing and accepting.
Technical support for Ampast Products and Services is provided subject to the terms of any valid support contract entered into between Ampast and the User.
Users who are not party to a valid support contract, and individual consumers, will receive technical support at the sole discretion of Ampast based on availability and the User's applicable region, as determined by Ampast from time to time.
Ampast makes no commitment to provide any minimum level of technical support to Users who are not party to a valid support contract.
No User may share, transfer, sublicense, distribute, resell, or make available any Ampast Product or Service, in whole or in part, to any third party without the prior express written permission of Ampast, unless such sharing is expressly authorized by Ampast in the applicable product documentation or terms.
No User may modify, reverse engineer, decompile, disassemble, adapt, or create derivative works of any Ampast Product or Service, in whole or in part, unless such modification is expressly authorized in writing by Ampast.
Abuse of any Ampast Product or Service is strictly prohibited. Ampast reserves the exclusive right to define conduct as constituting "abuse" on a case by case basis and to take any action it deems appropriate in response, including but not limited to immediate suspension or permanent termination of access, without liability to the User.
Ampast may release certain Products or portions of Products as open source projects. Any open source project is designated as such by Ampast with an accompanying open source license.
The release of a Product or portion of a Product as an open source project constitutes the exclusive permission from Ampast to use, modify, and distribute such Project in accordance with the terms of its accompanying license. No other provision of the Ampast GSP is modified or overridden by such release except as expressly stated in the applicable open source license.
Participation in Ampast open source projects is additionally governed by the Ampast Open Source Policy.
Ampast may employ artificial intelligence technologies, automated systems, and machine learning models extensively and at every stage and aspect of its Products, Services, operations, internal processes, and infrastructure, including without limitation in customer service, content moderation, product development, security monitoring, data analysis, and quality assurance.
Users acknowledge and consent to the use of artificial intelligence as described in Clause 12.1 as a condition of using any Ampast Product or Service.
Ampast may, at its sole discretion, delegate the provision of any Product, Service, or any portion thereof to any third party contractor, subcontractor, or partner. Any liability arising solely from such delegated Products or Services shall be the responsibility of the applicable third party, and Ampast shall bear no liability in connection therewith.
Ampast may sublicense any or all of its rights to its contractors and partners to facilitate the provision of any Product or Service.
Products and Services offered through Ampast Stores are subject to the exclusive rights of Ampast as the platform operator. Ampast reserves the right to approve, reject, remove, or restrict any Product or Service listed on any Ampast Store at its sole discretion and without liability.
Third party hardware and software listed on Ampast Stores are governed by the separate developer or manufacturer agreements applicable to those parties and are exempt from Clause 14.1 only to the extent expressly stated in those separate agreements.
Ampast may establish, modify, and enforce guidelines, review processes, content standards, revenue sharing terms, and other conditions for Products and Services distributed through Ampast Stores at any time, with or without prior notice.
Developers and publishers who list Products or Services on Ampast Stores grant Ampast the right to distribute, market, promote, and feature such Products and Services through Ampast channels, subject to the terms of the applicable store agreement.
The creation of an online account with Ampast, including accounts associated with Ampast email services, does not confer ownership of any Product, Service, feature, or content hosted by Ampast. An account grants only a limited, non-exclusive, revocable, non-transferable permission to access and use the applicable Products and Services in accordance with the Ampast GSP.
Ampast reserves the right to suspend, restrict, or terminate any account at any time for any reason, including violation of the Ampast GSP or applicable law, without liability to the account holder.
Not all Ampast Products, Services, or features are available in all regions or to all Users. Availability may vary based on geographic location, regulatory requirements, technical limitations, or Ampast's business decisions.
Ampast reserves the exclusive right, at its sole discretion, to deny access to any Product, Service, function, or component thereof to any person, age group, gender, organization, geographic area, region, or country, and to deny technical support to any of the foregoing, for any reason that Ampast deems appropriate, including but not limited to compliance with applicable law, risk management, or business strategy.
The Ampast GSP applies to all aspects of any product, service, or offering manufactured, programmed, sold, given away, sourced, or provided by any party other than Ampast that incorporates any contribution from Ampast, including but not limited to patents, application programming interfaces, scripts, software engines, hardware components, chips, designs, technical standards, or any portion of any Ampast Product or Service.
Any third party that incorporates or benefits from any Ampast contribution, technology, or intellectual property is bound by the provisions of the Ampast GSP to the extent applicable to such contribution, technology, or intellectual property.
If any provision of the Ampast GSP is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect the validity, legality, or enforceability of any other provision of the Ampast GSP, which shall remain in full force and effect.
Ampast reserves the right to update, modify, amend, or replace any provision of the Ampast GSP, in whole or in part, at any time, with or without prior notice to Users.
Continued use of any Ampast Product or Service following any update to the Ampast GSP constitutes the User's acceptance of the updated terms.
It is the User's sole responsibility to review the Ampast GSP periodically to remain informed of any changes. Ampast is not obligated to provide individualized notice of updates to any User.
All provisions of the Ampast GSP are designed to provide Ampast with the broadest possible legal protection and to minimize Ampast's legal and financial exposure. Any ambiguity in interpretation shall be resolved in favor of the construction that most benefits Ampast.
The Ampast Open Source Policy governs global collaboration on all Ampast designated open source projects. Participation in any such project constitutes acceptance of this policy in its entirety.
Ampast grants global permission for collaboration on Ampast designated open source projects. This permission is exclusive to each such project and is limited to the scope described in the applicable open source license accompanying that project.
This policy constitutes the exclusive written permission from Ampast for participation in open source projects designated under the Ampast OSP. No other rights are granted beyond those expressly stated in the applicable license.
Any contribution, submission, code, documentation, design, feedback, or other material provided by any individual or entity to an Ampast open source project may be used by Ampast for any purpose, including incorporation into proprietary, commercial, or non-commercial products and services, with or without attribution or credit to the contributor.
By submitting a contribution to any Ampast open source project, the contributor grants Ampast a worldwide, perpetual, irrevocable, royalty free, sublicensable license to use, reproduce, modify, adapt, distribute, and commercialize such contribution for any purpose, without restriction or compensation.
All Ampast open source projects and associated contributions are provided on an "as is" basis without warranty of any kind, express or implied, including without limitation any warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by applicable law, Ampast expressly disclaims all liability arising from or related to the use of, or inability to use, any Ampast open source project or any contribution thereto. Zero financial or legal liability attaches to Ampast in connection with any open source project.
This Privacy Policy governs the collection, storage, processing, use, sharing, and protection of all data, personal information, and content submitted to, generated by, or transmitted through any Ampast Product or Service. By using any Ampast Product or Service, each User consents to the data practices described herein.
This Privacy Policy applies to all Users and to all data collected, processed, stored, or transmitted in connection with any Ampast Product or Service, including hardware products, software products, operating systems, online platforms, artificial intelligence services, and email services.
By using any Ampast Product or Service, each User expressly and unambiguously consents to all data practices described in this Privacy Policy, including the collection, use, processing, sharing, sale, and transfer of User data as set forth herein.
This Privacy Policy is to be read in conjunction with the Ampast Terms of Service and the Ampast GSP. In the event of a conflict between this Privacy Policy and a valid official written contract to which Ampast is a named party, the terms of that contract shall prevail to the extent of the conflict.
Where Ampast expressly designates a specific feature or service as "zero knowledge," Ampast is technically unable to access the content of communications or files protected by that feature due to the architecture of the encryption system employed.
With respect to zero knowledge designated features, the data use, processing, training, and commercialization provisions of Section 3 of this Privacy Policy do not apply to the content of such protected communications or files, because Ampast does not have the technical ability to access such content. This exemption applies solely to the protected content and does not extend to associated metadata.
Notwithstanding Clause 2.2, metadata associated with zero knowledge communications, including but not limited to sender and recipient identifiers, timestamps, message sizes, and connection logs, may be collected and processed by Ampast in accordance with this Privacy Policy.
The zero knowledge designation applies only to the specific features or services for which it is expressly stated. All other Ampast Products and Services are subject to the full data practices described in this Privacy Policy.
Ampast collects and retains all data submitted to, generated by, or transmitted through Ampast Products and Services to the extent technically accessible to Ampast, including but not limited to usage data, behavioral data, communications data, account data, device data, content data, and personal information.
Ampast reserves exclusive and broad rights over all data it collects, including data hosted on its systems, data that Users sync to Ampast cloud or storage services, and data generated through the use of any Ampast Product or Service.
Ampast may use collected data for any lawful purpose, including without limitation: (a) service delivery and improvement; (b) security monitoring and abuse detection; (c) feature development and internal research; (d) training, fine-tuning, and improving artificial intelligence and machine learning models operated by Ampast or its authorized contractors; and (e) sale or transfer of aggregated, anonymized, or identifiable data to third parties, including advertisers and data analytics firms, for commercial purposes.
Users acknowledge and consent to all data practices described in this Section 3, including the potential sale of their data to third party advertisers and analytics firms, as a condition of using any Ampast Product or Service.
Ampast may disclose User data, including sensitive data, to law enforcement agencies, government bodies, regulatory authorities, or courts of competent jurisdiction when required to do so by a valid court order, subpoena, national security letter, or other legally binding demand issued under applicable law.
Ampast will, to the extent permitted by law, endeavor to notify the affected User of any such disclosure. Ampast reserves the right to make disclosures without prior User notification where prohibited by applicable law or order, or where Ampast determines in its sole discretion that immediate disclosure is necessary to prevent harm or comply with legal obligations.
With respect to zero knowledge designated features, Ampast's technical inability to access protected content means that Ampast cannot produce that content in response to a legal demand. Metadata associated with such features may, however, be disclosed in response to a valid legal demand.
Ampast implements technical and organizational security measures designed to protect User data against unauthorized access, loss, disclosure, alteration, or destruction. However, no system is completely secure, and Ampast does not warrant that its security measures will be effective in all circumstances. Ampast makes no commitment to any particular standard of data security except as expressly stated in a separate written agreement.
In the event of a data security incident that Ampast determines, in its sole discretion, to be material, Ampast will take such remedial actions as it deems appropriate and will provide notification to affected Users to the extent required by applicable law. Ampast's liability in connection with any data security incident is limited to the maximum extent permitted by applicable law and is subject to the limitations set forth in Section 4 of the Terms of Service.
This statement is made pursuant to applicable modern slavery and human trafficking legislation. Ampast is committed to acting ethically, with integrity, and with transparency in all of its business activities and supply chain relationships.

Ampast conducts due diligence on its supply chain and business relationships to identify and address any risk of exposure to modern slavery or human trafficking. This includes review of supplier practices, contractual obligations requiring compliance with applicable anti-slavery laws, and ongoing monitoring of high-risk supply chain relationships.
Ampast provides appropriate training and awareness to its employees and relevant contractors regarding the risks of modern slavery and human trafficking and the steps they are required to take if they identify or suspect such conduct within Ampast's operations or supply chain.
Any person who has concerns about modern slavery within Ampast's operations or supply chain is encouraged to report those concerns through Ampast's designated reporting channels. Reports may be made anonymously where permitted by applicable law, and Ampast prohibits retaliation against any individual who makes a good faith report.

Ampast's equal treatment commitment applies to all personnel engaged by Ampast, including full-time employees, part-time employees, fixed-term employees, contractors, interns, apprentices, and other engaged personnel, regardless of their mode of engagement.
Any employee, contractor, or individual who believes they have been subject to treatment in violation of this statement may report their concern to Ampast's designated human resources or compliance function. All reports will be reviewed and addressed in accordance with Ampast's internal investigation procedures. Ampast prohibits retaliation against any individual who makes a good faith report under this statement.
